1PaperCut, and or its Affiliates, provide users (each, a “User”) with www.1PaperCut.com website (“Site”) features subject to the terms and conditions set forth below. Users who visit or shop at the Site accept these Terms and Conditions. If Users do not agree to abide by Site policies, please do not enter the Site. 1PaperCut reserves the right to change these Terms and Conditions at any time at our sole discretion. If Users violate any of the Terms and Conditions set forth, Users terminate their access to the Site.

YOUR ACCOUNT

Users are responsible for maintaining the confidentiality of the information submitted, including passwords, and for restricting access to User’s computer and/or Account. Users are responsible for all activities that occur under My Account or User’s password. 1PaperCut reserves the right to terminate accounts, or refuse service, or remove or edit content, or cancel orders at our sole discretion.

SITE ACCESS

Users agree not to download (other than page caching) or modify the Site in any way. Users may not reproduce, duplicate, copy, sell or exploit for commercial purpose any portion of the Site. Users may not use 1PaperCut’s logo, or other proprietary graphics, or content without 1PaperCut’s written permission.

COPYRIGHT

Users acknowledge that all content on the Site, such as copy, graphics, logos, data, photographs, and other material are the property of 1PaperCut, or its content suppliers. All design and copy used on this Site and all software used on this Site are the property of 1PaperCut, or its software suppliers.

POSTINGS AND GENERAL ONLINE CONDUCT

Users may post reviews, make comments, send photos, and send other communications including suggestions, ratings, comments or questions as long as the content is not illegal, invasive of privacy, defamatory, threatening, obscene, is not sexually explicit, hateful, racial or ethnic, does not represent an infringement of intellectual property and is not injurious to third parties and does not contain software viruses, commercial solicitation, or mass mailings. Any form of spam will not be acceptable. Users may not impersonate a false email address or any person or entity. Users agree to use our site for only lawful purposes. 1PaperCut reserves the right at our sole discretion to remove or edit any harmful content and reserves the right to prohibit conduct or communications that harm the Site or customers. If Users do post content or submit material to the Site, you grant 1PaperCut an irrevocable, non-exclusive, without royalty, and sub-licensable right to use, modify, reproduce, publish, adapt, translate, distribute and display any content you have sent on the Site.

TERMINATION ON USE OF OUR SITE

1PaperCut may terminate User’s access to all or part of the Site without notice for any conduct in our sole discretion that may be harmful or unlawful or is in breach of the 1PaperCut Terms and Conditions or other policies. We also reserve the right to cancel or refuse an order at any time solely at our discretion.

CONSENT FOR ELECTRONIC COMMUNICATIONS

Users will be communicating with 1PaperCut electronically when visiting the Site, or send emails. 1PaperCut will communicate with Users by email or by postings on the Site. Users agree 1PaperCut has the right to send Users notices and other communications in connection with our Site, utilitzing the  email address Users have provided. If Users do not wish to receive notices or email communications, Users are able to unsubscribe to withdraw consent under applicable law. Users also agree that all notices and other communications that 1PaperCut provides to Users electronically satisfy any legal requirement that such communications be in writing.

RISK OF LOSS

All purchases from 1PaperCut are made pursuant to a shipment contract which means that the risk of loss and the title for such purchases pass to Users upon delivery from our carrier.

PRODUCT DESCRIPTION AND POSSIBLE ERRORS

1PaperCut provides descriptions of product including sizes and features and other information that is believed to be as accurate as possible. Despite the best of efforts, errors can occur in product descriptions. Errors will be corrected as discovered. 1PaperCut does not provide any warranties that the product descriptions or other content of our site is accurate, current, complete, or without possible errors.

PRICES QUOTED

1PaperCut quotes all prices for products or services in US $ dollars. Prices on the Site are subject to change without notice. Despite the best of efforts, errors can occur in prices quoted. Errors will be corrected as discovered. When a pricing error occurs, 1PaperCut is under no obligation to ship the order at the incorrect price regardless of the possibility that an order confirmation or shipping confirmation may have already been sent. Despite the best of efforts, miscalculations of retail prices, everyday prices, discounts, and shipping charges can occur.

STOCK AVAILABILITY

1PaperCut makes every effort to maintain stock availability and to represent availability correctly on our Site. Despite the best of efforts, errors in stock availability can occur. Users acknowledge that products on our Site can sell quickly and stock balances may be sold out by the time Users place orders. Users acknowledge that errors on stock availability can occur at any time during the fulfillment and shipping process. Users agree 1PaperCut may cancel orders due to unavailable stock at any time without penalty. 1PaperCut does not provide a warranty that stock availability is always accurate, current, complete, or without error.

SHIPPING POLICIES

Please see Shipping Information for shipping and delivery policies. 1PaperCut make our best efforts to ship an entire order together. Sometime this does not occur due to product being out of stock or for other reasons. Users agree that PayPal accounts, credit and debit cards, and other forms of online payments are to be charged as of the date of inventory being reserved for the order and not the date of shipping or receipt.

SALES TAX

Purchases to be shipped to California addresses are subject to current state tax rates. External to the State of California, consult your own tax advisor to determine if taxes are owed in User’s  state on your internet purchase.

MINORS USE OF OUR SITE

1PaperCut relies on parents, or guardians, or anyone responsible for minors under the age of 13, to supervise and decide which content is appropriate to look at or purchase. If Users register on the Site, it is assumed that Users are 13 years of age, or older, and can enter into a contract, or if under the age of 13 or under legal age of consent, Users have parental permission to enter into a purchase contract.

APPLICABLE LAW

If Users access our site from anywhere in the United States or Canada, Users agree that the laws of the State of California, and the United States, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and the Site, 1PaperCut, and its Affiliates.

DISPUTES

Any disputes relating in any way to Users’ visit to our Site, or to these 1PaperCut Terms and Conditions or to any of our other policies including 1PaperCut’s Privacy Policy or to any purchase Users have made through our Site shall be submitted to confidential arbitration in the state of California. Arbitration shall take place under the rules of the American Arbitration Association. The arbitrators’ decision will be binding. Such arbitration decision may be entered as a judgment in any court of competent jurisdiction.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

1PaperCut provides our Site on an “as is” basis. 1PaperCut makes no representations or warranties of any kind, express or implied, concerning its content, products, information presented, software, services made available to Users through our Site or electronic communications from 1PaperCut to you. 1PaperCut will not be liable for any damages resulting from the use of our Site.
